The group representing residents on the Rutland, Lincolnshire border against the Mallard Pass solar farm say they're not going to pursue a judicial review into the decision taken by the new Labour Government to grant planning for it in their first few days of office.
They say it is with a very heavy heart they've made the decision. After reviewing all the implications, including taking legal advice, they've decided it's not viable to challenge the government's decision making. They say they could find no substantive errors to question and that the odds are stacked too much against them. The Mallard Pass Action Group says it will continue to support residents and work with the local and parish councils to make sure construction is properly managed. At the moment, they say Network Rail hasn't yet reached agreement as to whether cabling will go under the railway or through the centre of Essendine, and therefore whether compulsory land acquisition will take place and whether that will be needed.
