Rutland County Council's Planning Committee say, despite Anglian Water saying they haven't got the capacity to take away the wastewater on a new development in Great Casterton, they were powerless to refuse the application for 58 houses backing onto Ermine Rise.
A lack of five year housing supply in the county after increased government targets was blamed and a fear of legal costs after a scheme on Brooke Road in Oakham cost the council thousands of pounds after they refused it partly on traffic congestion grounds, which went against the developer's survey, and also a scheme refused by the council on College Close in Great Casterton, which was then approved. Cases elsewhere have shown water companies need to be forced to find a solution when citing capacity issues.
